Terms & Conditions of use (website)

Permission is granted to use the materials on Yoga with Jack’s website for personal, non-commercial transitory viewing only.

This is the grant of a licence, not a transfer of title, and under this licence you may not: a) modify or copy the materials,
b) use the materials for any commercial purpose, or for any public display (commercial or non-commercial),

c) attempt to decompile or reverse engineer any software contained on the Yoga with Jack website,
d) remove any copyright or other proprietary notations from the materials,
e) transfer the materials to another person or ‘mirror’ the materials on any other server.

This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Yoga with Jack at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.

Limitations

In no event shall Yoga with Jack or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Yoga with Jack’s website, even if Yoga with Jack, or a company authorised representative, has been notified orally or in writing of the possibility of such damage. Refund and cancellation Policy

Retreats

Please ensure you are available for the retreat dates when booking.
Retreats are non-refundable and by making payment you agree to these terms.
You may transfer your place in the retreat to someone else no later than 72 hours before the start of the retreat.
Bookings are non-transferable within 72 hours of the retreat start.

Yoga Courses

Please ensure you are available for the course dates when booking.
Payments for yoga courses are non refundable.
Course bookings may not be transferred from the person for whom they are purchased to any other group or individual. Bookings are non-transferable.
No refunds will be issued unless Yoga with Jack must cancel a class or workshop at the last minute.
Course dates are non-transferrable. For example If you purchase a Thursday evening class you cannot transfer to the Tuesday evening class for any reason.
Yoga with Jack reserves the right to refuse admission to classes.
Students must arrive no later than 5 minutes before class start time. Late-comers will not be admitted to class after class start time. Please call the studio ahead of time to warn us if you are late.

Meditation Courses

Please ensure you are available for the course dates when booking.
Payments for meditation courses are non refundable.
Course bookings may not be transferred from the person for whom they are purchased to any other group or individual. Bookings are non-transferable.
No refunds will be issued unless Yoga with Jack must cancel a class or workshop at the last minute.

Meditation & breathwork is not a substitute for medical counselling or treatment. If you have any doubts about the suitability of the exercises you should refer back to your medical practitioner. You accept all responsibility for any risks, injuries, damages, known or unknown, that you might incur as a result of participating in the sessions.

Physical Injuries

By participating in Yoga with Jack’s classes you are voluntarily engaging in an acceptable level of exercise, and your participation involves a risk of injury. You understand that it is your responsibility to consult a GP prior to participating in the classes or retreats if necessary, and that by voluntarily partaking in the classes or retreats you accept all responsibility for any risks, injuries, damages, known or unknown, that you might incur as a result of participating. Yoga training is not a substitute for medical counselling or treatment. If you have any doubts about the suitability of the exercises you should refer back to your medical practitioner.

By participating in classes or services during you understand you will receive information and instruction about yoga. You agree to assume full responsibility for any risks, injuries or damages, known and unknown, which you might incur as a result of participating in these classes. In further consideration of being permitted to participate in the yoga classes, you knowingly, voluntarily, and expressly waive any claim you may have against representative of Jack Marshall, the class instructor, the owner, or the owner of the building for injuries or damages that you may sustain as a result of participating in classes or workshops. I have read the above release and waiver of liability and fully understand its contents. You voluntarily agree to the terms and conditions stated above.

You hereby give consent to waiver any right to claim for personal injury resulting from participation in retreats hosted by Jack Marshall. You fully understand that in so wavering your right you will not be able to make financial claim against him or any representative on his behalf. You hereby authorise and request participation in all live classes included in the classes or retreats on that basis.

Pregnancy

My qualifications do not cover me to teach pregnant persons. If you are pregnant it is not advised to take part in my classes. Please notify me if you are pregnant and I will find a suitable teacher.

Meals

You must notify us at least 48 hours prior to the Start Date of the Retreat if you have any food allergies, intolerances, medical conditions or other dietary requirements. While we will use our best endeavours to ensure all meals consider food allergies and intolerances, we cannot guarantee any meals will be suitable and you will be responsible for notifying us in advance of any dietary requirements.

This is so we have all the necessary information in advance to assess if the retreat is appropriate. Yoga with Jack will not be able to cater for any dietary requirements if guests do not disclose all information on the health form in advance.

Please note we serve plant based meals that are dairy free. We do not cater for complex dietary requests ie FODMAPs, fructose intolerance, grain intolerance or any guest who requires separate meals to be made. Please contact us if you need more information.

Coaching – Terms and Conditions

  1. As a client, you understand and agree that you are fully responsible for your physical, mental and emotional well-being during the coaching calls, including your choices and decisions. You are aware that you can choose to discontinue coaching at any time.
  2. You understand that “coaching” is a Professional-Client relationship you have with Jack that is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
  3. You understand that coaching is a comprehensive process that may involve all areas of your life, including work, finances, health, relationships, education and recreation. You acknowledge that deciding how to handle these issues, incorporate coaching into those areas, and implement your choices are exclusively your responsibility.
  4. You understand that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association (APA) or the European Psychiatric Association (EPA). You understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and you will not use it in place of any form of diagnosis, treatment or therapy.
  5. You promise that you are currently in therapy or otherwise under the care of a mental health professional, that you have consulted with the mental health care provider regarding the advisability of working with a coach and that this person is aware of your decision to proceed with the coaching relationship.
  6. You understand that information will be held as confidential unless you state otherwise, in writing, except as required by law.
  7. You understand that certain topics may be anonymously and hypothetically shared with other coaching professionals for training OR consultation purposes.
  8. You understand that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals. You will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. You understand that all decisions in these areas are exclusively yours and you acknowledge that your decisions and actions regarding them are your sole responsibility.

Services:

The services to be provided by the coach to the client are face-to-face or Zoom-coaching, as agreed jointly with the client. Coaching may address specific personal projects, business successes, or general conditions in the client’s life or profession.

Other coaching services include value clarification, brainstorming, identifying plans of action, examining modes of operating in life, asking clarifying questions, and making empowering requests or suggestions for action. Throughout the working relationship, the coach will engage in direct and personal conversations.

The client understands that successful coaching requires a co-active collaborative approach between client and coach. In the coaching relationship, the coach plays the role of a facilitator of change, but it is the client’s responsibility to enact or bring about the change.

Prior History:

The client also agrees to disclose details of the past or present psychological or psychiatric treatment. In entering into the coaching relationship, and signing the agreement, you are agreeing that if any mental health difficulties arise during the course of the coaching relationship, you will notify me immediately so that I can discuss with you appropriate steps and if any additional referrals are needed.

Privacy:

The client can, at any point in the coaching session, declare his/her preference not to discuss a specific issue, by simply stating that they would rather not discuss this issue. The coach agrees to respect this boundary and will not attempt to forward the conversation further along those lines.

Confidentiality:

All information about the coach / client relationship will remain strictly confidential.

If you wish for me as your coach to speak to someone outside our interactions, then you need to give me written permission (original letter, fax or email) to do so. Exceptions to confidentiality of course relate to circumstances such as intent to seriously harm someone, child abuse etc. Otherwise, all your information is confidential.

It is also important to note that in some situations, it is important to be aware of the use of technology in that for some clients, there is a risk in using certain media such as the internet, mobile phones and cordless phones. If you use these to communicate with me, then I will assume that it is appropriate to continue to do so in my interactions with you.

Termination

Coaching under the terms and aforementioned agreements will continue for the duration of the contracted period. Only under extenuating circumstances can our coaching agreement be postponed up to 6 months of the said agreement.
